By accessing or using GeckoGuard ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and GeckoGuard. By creating an account, subscribing to a plan, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

You must be at least 18 years old to use GeckoGuard. By using the Service, you represent and warrant that:

• You are of legal age to form a binding contract
• You have the authority to enter into these Terms on behalf of yourself or your organization
• All information you provide is accurate, current, and complete
• You will maintain the accuracy of such information

You are responsible for maintaining the confidentiality of your account credentials, including your email address and password. You agree to:

• Use a strong, unique password
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with third parties

GeckoGuard is not liable for any loss or damage arising from your failure to comply with these security obligations.

Subscriptions: GeckoGuard offers various subscription plans. By subscribing, you agree to pay the fees associated with your selected plan. Subscriptions automatically renew unless cancelled.

Billing: Fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees. If payment fails, we may suspend or terminate your access.

Refunds: We offer a 14-day money-back guarantee for new subscriptions. Refund requests must be submitted within 14 days of your initial purchase.

Taxes: You are responsible for any taxes, duties, or fees imposed by your jurisdiction. Prices displayed are exclusive of applicable taxes unless otherwise stated.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds for partial billing periods.

License Keys: GeckoGuard enables you to create and manage license keys for your software products. You are responsible for:

• Ensuring license keys are used in accordance with your own terms and applicable laws
• Protecting your API keys and credentials
• Complying with usage limits associated with your subscription plan
• Not exceeding the number of licenses, products, or team members included in your plan

Products: A "product" in GeckoGuard represents a software application or service you want to protect. You may create multiple products subject to your plan limits.

Usage Limits: Exceeding your plan's limits may result in service restrictions or require plan upgrades. We will notify you when approaching limits.

You agree not to use GeckoGuard to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's operation or security
• Use automated systems to abuse or overload our infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute the Service without authorization
• Use the Service for illegal activities or to protect illegal software

Your Data: You retain ownership of all data, content, and license keys you create using GeckoGuard ("User Content"). You grant us a limited license to use, store, and process User Content solely to provide and improve the Service.

Data Security: We implement industry-standard security measures to protect your data. However, you are responsible for backing up your data. We are not liable for data loss.

Data Deletion: Upon account termination, we will delete your User Content in accordance with our data retention policies, typically within 30 days.

Privacy: Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

GeckoGuard may integrate with third-party services, including payment processors, email providers, and analytics tools. Your use of such services is subject to their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services. Any disputes with third-party providers must be resolved directly with them.

Our IP: The Service, including its software, design, logos, and documentation, is owned by GeckoGuard and protected by intellectual property laws. You receive no ownership rights in the Service.

Your IP: You retain all rights to your User Content. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use your User Content solely to provide the Service.

Trademarks: "GeckoGuard" and related marks are our trademarks. You may not use our trademarks without prior written permission.

You agree to keep confidential any non-public information about GeckoGuard's technology, business practices, or pricing that you may learn through your use of the Service.

This obligation does not apply to information that is publicly available, independently developed by you, or required to be disclosed by law.

To the fullest extent permitted by law, GeckoGuard disclaims all warranties, including but not limited to:

• Merchantability, fitness for a particular purpose, and non-infringement
• Uninterrupted, secure, or error-free operation
• Accuracy, completeness, or reliability of the Service
• That defects will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

To the fullest extent permitted by law, GeckoGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Service interruptions or downtime
• Costs of substitute services
• Damages arising from your use or inability to use the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless GeckoGuard, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

By You: You may terminate your account at any time by canceling your subscription and deleting your account through the Service or by contacting support.

By Us: We may suspend or terminate your access to the Service immediately, without prior notice, if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Pose a security risk to the Service or other users

Upon termination, your right to use the Service ceases immediately. We may delete your account and User Content in accordance with our data retention policies.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.
